Try to get hold of the Bar Association in the area, or get hold of
some legal referral service. Call directory assistance in the area
and ask them if they can help you locate a legal referral service.
They are usually listed it he Yellow Pages. If nothing else get
hold of the Chamber of Commerce. Find a lawyer in the area to handle
this. The first thing to file is a request for extension of time to
reply. They are usually granted if your request for extension is filed
    in time.
Most states do not take into account the spouse's income. Apparently
some do. That will be one of the first things to check out with the
    lawyer.

| | Wouldn't the papers have to come from the court and not the ex? Steve's
daughter's mother told him she had court papers for him to show up in court
and our response was "yeah, right". The court always contacted us previously.
She also offered to cut Steve's support payment in half if he would send it
straight to her. Tempting, but not without a court order. She could probably
forsee the payments getting cut off after she left her kids with her folks.
She thinks she's slick, but she didn't get away with it this time. I just
wish I could see her face now!
Sounds fishy to me, but I would check it out with a lawyer before agreeing
to anything!!!

Hi folks, thanks for the inputs. I contacted the Cochise County
lawyers office. A case worker will be calling me later today or
    tomorrow morning.

I've never been served papers by anyone but the court. I suspect
it isn't all on the up & up. My wife flies to Arizona on the 22nd
for her Thanksgiving visitation with her children. They always
pull some crap just before she goes to make her visit as terrible
as possible. We know they'll pull something everytime.

We bring her children here to Mass for 5 weeks in the summer. They
nearly have a bird everytime the kids come. They (kids) never want to go
back. Her daughter is ten, getting near that age when the teen years
start. We're 99% sure her daughter is going to move here first chance
she can. We have started plans to get custody.

    Thanks for your help folks.

| | re service
In some courts (Colorado) "service" is by mail or in person. Only
some specialized cases like initial filing must be in person. After
that, service can be by mail. File one copy with the Court along
with an affidavit saying you mailed a copy to xxxx at address
yyyyy on date zzzzzzz. Mail the other copy to the other party.
Keep the envelope and the postmark. If their affidavit says they
mailed it on xxxx and the postmark says yyyy, then they could be
    in some deep &^%#@.

My wife has been to Arizona and retained a lawyer (Thanksgiving 1994).
She asked for several items in our reply to his increase for child
support. My wifes ex met with my wifes new lawyer in Arizona on Decemeber
23 (Merry Christmas buddy). He was required to bring paperwork for
his disposition (Salary, bonus etc..). We came close to winning ...
she will most likey not have to travel back to Arizona to get this
    resolved.

The initiation of this action paperwork was filed by my wifes ex's new
wife. Make any sense? He wanted to let sleeping dogs lie, but the new
    wife in Arizona got greedy.

He wanted $300 month child support, court guideline states she (my
wife) could be libel for up to $370, he asked/settled for $225. He
doesn't cash the child support checks sent to him now and the children
are not suffering due to lack of child support. We think she (new
wife) was complaining about getting more money.

He agreed to pay for 1/2 of the cost of visitation. This summer
airfair and travel expense was $1900.00. He was required to pay nothing
before. There is also a Thanksgiving/Christmas visitation expense as
well of which he'll be required to cover.

My wife will get to see her children every day she is in Arizona. They
have always jerked my wife around on when she could/couldn't see the
kids. If she was in Arizona ten days she might see them 5 or 6 days.

They also agreed to keep of the phone and not interferewith my wifes
visitation with her children on the phone. They usually talk every
week with all the back ground crap going on.

He agreed the could call direct, they have always call collect $40-50 per
month. This will save us $200 or so a year.

He didn't agree to pay court fees. Our lawyer advised we wouldn't win
    this but we would try.

My wife didn't get to take either child as a deduction. He wanted to
keep them for tax purposes. This actually saved us money, he reduces
is tax base with one extra deduction (we were hoping for one based on
paying the $4440 a year C.S.), we save $1740 in lower child support.

He agreed to open the childrens school and medical records. These was
    also a issue before.
