    Chubbys went out of business. I think the food was good but the service
    was not. I hear that a Tocco shop will open in its place, run by one

|  |     I saw in yesterday's Beacon that the Bagel Stop is being thwarted in
    his attempt to move to a bigger store... I think it's the one on Main
    St that used to house Village Jewelers [who, by the way, have gone out
    of business in the Assabet Mall, with no notice in any paper].  The
    article also mentioned that 4 other businesses had just closed up shop 
    this past month -- who?  Main street looks so bad right now.

|  |     I will try to explain what is happening with the Bagel shop.  In
    October the Bagel shop was going to move to the building Century 21 was
    vacating on Nason St..  Mark Strauss the owner of the Bagel shop was
    told then, he would have to go thru the Site Plan approval process.  Mark
    Strauss was suppose to meet with the Planning Board on December 13th to
    discuss the process.  He never showed up.  I heard a few weeks later
    that he wasn't moving to Nason St., but was going to move to Main St..
    
    Sometime in December Mark's lawyer called the towns' legal counsel to
    discuss the site plsn process.  Town counsel told him he had to conform
    to the process.  After Christmas Mark called me and other board
    memebers to see if we would waive the process.  Since we have made all
    other businesses go thru this process, the Bagel shop must do so also.
    However, The Planning board and the building expector have agreed to
    let Mark start the demolition on his new site before the site plan
    process starts.
    
    In the meantime Mark has gone to the Beacon, the Chamber of Commerce,
    some members of the Selectmen, telling them we are thwarting his
    business.  The Planning Board can't be blamed for Mark changing his
    mind on his new location for his business, and for having his lease
    expire.  Which does not give him enough time to adhere to the towns
    regulations and move to his new site.
    
    I have heard that the reason some of the other businesses in the mall
    have closed, is because the owner of the mall is cancelling all the
    leases.  They plan on using to most mall for office space.

Not that you have to answer this Paul but could you comment on the
discrepency between the statement:

[I only know about this because I happened to pick up a copy to see how
 badly they mangled my quotes on the Joe Magno feature...]

|  |     Grappa's was given a waiver because there wasn't a change of use.  The
    building was the Red Door Cafe, which was mostly a bar room, but it did
    serve food and it did have a small kitchen.
    
    Site Plan approval process is required when there is going to be a
    significant change of use or if there is going to be significant change 
    in the foot print of the building (expansion).  Pep's Gym had to go thru
    Site Plan.  Mr. Paul is adding a small bakery next to his gym.  This
    bakery is going to sell some type of health muffins, biscuits, coffee
    etc..  Wendy's, Christmas Motors, The Thai restaurant, Chubby's
    Chicken, TC Lando's, just to name few, all had to adhere to the site
    plan approval process.  Most towns have a site plan process. For
    example Wendy's had to go thru the process with Maynard and Acton,
    because the site is in both towns.

When they renovate that building, ALL of the exterior and interior walls
were removed!  The only thing that remained the same was the foundation
and the frame.  If that didn't require a site plan, then something is wrong!

|  | Then I suppose Grappa really didn't get a waiver then, since (apparently)
there was *nothing* to waive -- they were simply able to proceed without
a site plan approval because they were within the regulations or whatever.
(A waiver, to me, implies that someone is permitted a shortcut around
normal rules for some set of extenuating circumstances).

|  |     Dave you are correct.  Site plan was not waived for Grappa's, the
    regulation did not apply.  The process for Site Plan usually proceeds
    as follows:  An applicant goes to the building inspector for a building
    permit.  The building inspector reviews the plans.  If the building
    inspector thinks the plans fall under the site plan process he sends
    the applicant to the planning board.  The board then rules if the site plan
    process applies.  You can altar a building considerably without
    expanding and site plan does not apply.  For example Digital has been
    renovating the mill for years, but they did not change the exterior 
    foot print of the building.  DEC did not have to go thru the site plan
    process.

   the Mill is vacated.  Mark had to lay off some of his lunchtime
   help, it's more like Saturday business there during the week these
   days.
